1. Scope
- These Terms set out how the Provider supplies electronic services through the Service, in particular:
- the types and scope of the Services — section 4;
- technical requirements — section 5;
- how agreements for the Services are concluded and terminated — sections 6, 7 and 12;
- buying and using Pro — sections 8 and 9;
- intellectual property and use of Designs — section 10;
- the complaints procedure — section 14.
- These Terms are the terms of service required by the Polish Act of 18 July 2002 on providing services by electronic means.
2. Provider
- The Provider is Tomasz Kustrzyński, a sole trader operating as Tomasz Kustrzyński, registered in the Polish Central Register and Information on Economic Activity (CEIDG), tax ID (NIP): 8981954860, Poland.

3. Definitions
- "Provider" — the person named in section 2.1.
- "User" — any person or organisation using the Service.
- "Consumer" — a User who is a natural person acting for purposes outside their trade, business or profession. Where Polish law extends consumer protection to sole traders buying for purposes that are not professional for them, the provisions on Consumers apply to them accordingly.
- "Service" — the website at https://laserpuzzle.app, including the information pages, the App, the Pricing and the legal documents.
- "App" — the software at https://laserpuzzle.app/app/ that runs in the User's web browser and creates Designs with Generators.
- "Generator" — a module of the App that creates a Design from parameters entered by the User and, for some Generators, a User File.
- "Standard Generator" — a Generator that is part of the laserpuzzle software released under the GNU General Public License, version 3 or later.
- "Pro Generator" — a Generator marked "Pro" in the Service that is not a Standard Generator, available only with Pro.
- "User File" — a file (in particular a 3D model in STL format) the User selects in the App.
- "Design" — the output of a Generator, in particular SVG, DXF and STL files, the 3D preview, parts list and assembly notes.
- "Account" — the record in the Provider's systems, identified by the User's email address, that holds the User's Pro status.
- "Pro" — the paid scope of the Services giving access to Pro Generators, bought as:
- "Pro Monthly" — a subscription renewing every month;
- "Pro Yearly" — a subscription renewing every year;
- "Pro Lifetime" — a one-time payment for access for as long as the Service is provided, as set out in section 8.6.
- "Pricing" — the prices and options for Pro shown at https://laserpuzzle.app/#pricing and in the Paddle checkout.
- "Paddle" — Paddle.com Market Limited, 30 Old Bailey, London, EC4M 7AU, United Kingdom, acting as merchant of record for Pro.
- "Service Agreement" — the agreement described in section 6.
- "Account Agreement" — the agreement described in section 7.
- "Services" — the electronic services the Provider supplies through the Service, described in section 4.
- "Privacy Policy" — the document describing how personal data is processed in the Service, at https://laserpuzzle.app/privacy.
- "Terms" — these laserpuzzle.app Terms of Service, including Annex 1.
4. Services
- The Provider supplies:
- the App and the Standard Generators — free of charge, without an Account;
- the Account — free of charge;
- the Pro Generators with Pro — for a fee, per the Pricing.
- The App runs in the User's browser. User Files and Designs are processed only on the User's device and are not sent to the Provider. The Provider does not store User Files or Designs.
- Designs are generated automatically from the User's parameters. The App checks some properties of a Design (in particular collisions between parts in the 3D model) and reports problems it finds. Before cutting a whole Design, the User should make a test cut (for example with the "Fit test" Generator) on their own machine and material.
5. Technical requirements
- To use the Service you need:
- a device with Internet access;
- a current web browser supporting JavaScript, WebAssembly and Web Workers (such as Chrome, Edge, Firefox or Safari);
- on the first start of the App, the ability to download about 25 MB;
- at least 4 GB of device memory is recommended; large User Files may need more;
- to use an Account, a working email address and cookies enabled.
- To cut a Design you need software that reads SVG or DXF and a laser cutter. The Provider supplies neither.
6. Service Agreement
- The Service Agreement is concluded, for an indefinite period, when the User opens the Service in a browser.
- It ends when the User closes the Service. The User may stop using the Service at any time at no cost.
7. Account
- The Account Agreement is concluded when the User accepts these Terms and confirms their email address through the link the Provider sends. An Account may also be created automatically for the email address given when buying Pro.
- Sign-in is by a one-time link sent to the User's email address or, where offered, by a Google account. The Service does not use passwords.
- A User may be signed in on at most 3 (three) devices or browsers at once. Signing in on another device signs out the least recently used session.
- An Account is for one person. The User must not share it with others.
- The Account Agreement is for an indefinite period. The User may end it at any time by deleting the Account in the Account settings or by emailing the address in section 2.2.1. Deleting the Account does not by itself refund Pro; refunds are covered by section 11.
8. Pro
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle handles checkout, payment, invoices and receipts, payment refunds and sales taxes. Paddle's buyer terms, shown at checkout, apply to the purchase.
- The Provider gives access to the Pro Generators to the User whose Pro payment Paddle has confirmed, on the Account for the email address used at checkout. Access is activated once Paddle confirms the payment, usually within minutes.
- Prices are shown in US dollars (USD). Paddle shows the total price, including taxes due in the User's country, before the order is placed.
- Pro Monthly and Pro Yearly renew automatically for periods of the same length, with Paddle charging at the start of each period, until cancelled. The User may cancel at any time in the Account settings (Paddle customer portal) or at https://paddle.net. Cancellation takes effect at the end of the current paid period, until which access continues.
- The Provider will email the User about a price change for Pro Monthly or Pro Yearly at least 30 (thirty) days before the billing period from which the new price applies. A User who does not accept it may cancel under section 8.4 before that period starts. Price changes never apply to periods already paid.
- Pro Lifetime gives access to the Pro Generators, including Pro Generators released later, for as long as the Provider provides the Service, with no further payments. If the Provider intends to permanently stop providing the Service, it will notify Pro Lifetime Users at least 90 (ninety) days in advance. If the Provider permanently stops providing the Service less than 24 months after the date on which a User bought Pro Lifetime, the Provider will refund that User part of the price paid, in proportion to the months of that 24-month period still remaining on the day the Service ends (a month that has started counts as used). The Provider arranges the refund through Paddle, to the payment method used for the purchase, without the User having to ask for it. This does not limit the User's statutory rights.
- Pro belongs to one Account and cannot be transferred to another Account without the Provider's consent.
9. Acceptable use
- The User must use the Service lawfully, in line with these Terms and good practice.
- In particular, the User must not:
- provide unlawful content;
- disrupt the Service, including attacking the Provider's systems, bulk-downloading the Service's resources automatically or sending excessive requests;
- circumvent the technical measures that restrict access to Pro Generators, including using Pro Generators without active Pro;
- copy, distribute, share or resell Pro Generators or their code, subject to section 10.4;
- share their Account.
- Sections 9.2.3 and 9.2.4 do not limit any rights the User has in the Standard Generators under the GNU General Public License.
10. Intellectual property and Designs
- The Service, the App, the Pro Generators and the Service's marks and graphics are protected by copyright and other intellectual property rights of the Provider or third parties.
- The Standard Generators are released under the GNU General Public License, version 3 or later. Their source code is at https://github.com/fikander/laserpuzzle. Third-party software and its licences are listed at https://laserpuzzle.app/licenses.html.
- When Pro is activated, the Provider grants the User a non-exclusive, non-transferable, worldwide licence, without the right to sublicense, to use the Pro Generators within the App for the duration of Pro, to the extent needed to use them as intended, including reproducing them permanently or temporarily in the memory of the User's device in order to run them.
- Nothing in these Terms excludes the User's rights under Article 75(2) and (3) of the Polish Act of 4 February 1994 on Copyright and Related Rights (which implement the EU rules on back-up copies, observing a program's functioning, and decompilation for interoperability).
- The Provider claims no rights in User Files or Designs. The User may use Designs, and objects made from them, for any purpose, including commercially, in particular by selling the objects made. The Provider may introduce a separate plan for commercial use (for example a business plan). Any limit on the commercial use of Designs created with Pro Generators may apply only to Pro purchased after the change has been announced and published in these Terms; it does not affect Pro purchased earlier.
- The User is responsible for ensuring that User Files do not infringe third-party rights, in particular copyright in 3D models.
11. Right of withdrawal and refunds
- A Consumer who concludes a distance contract may withdraw from it without giving a reason within 14 (fourteen) days of concluding it.
- In addition to statutory rights, every User, whether or not a Consumer, may get a full refund of a Pro payment without giving a reason within 14 (fourteen) days of the purchase, or of the renewal of a yearly subscription, whether or not they used the Pro Generators.
- A withdrawal or refund request may be made:
- at https://paddle.net (look up the order by email); Paddle, as the seller, makes the refund;
- by email to the address in section 2.2.1; the Provider forwards the request to Paddle. A Consumer may use the model withdrawal form in Annex 1 but does not have to.
- The refund is made to the original payment method within 14 (fourteen) days of Paddle or the Provider receiving the request. Access to the Pro Generators ends when the refund is made.
- The Service Agreement and the Account Agreement are free of charge; the User may end them at any time under sections 6.2 and 7.5.
12. Suspension and termination by the Provider
- The Provider may suspend access to an Account if:
- the User breaches section 9.2;
- there are reasonable grounds to suspect the Account is used by an unauthorised person.
- The Provider will email the User the reason for the suspension and give at least 7 (seven) days to remedy the breach or explain. If that period passes without effect, the Provider may terminate the Account Agreement with 14 (fourteen) days' notice.
- The Provider may terminate the Account Agreement for other important reasons with 30 (thirty) days' notice, stating the reason. The User then receives a pro-rata refund for the unused part of a Pro period.
13. Liability
- The Provider is liable to Consumers for the conformity of the Services with the contract under Chapter 5b of the Polish Consumer Rights Act of 30 May 2014. Nothing in this section excludes or limits Consumers' statutory rights.
- The Provider works to keep the Service available but does not guarantee it is available at all times. The Provider may limit availability temporarily for maintenance or development and, where possible, announces planned interruptions longer than 2 (two) hours in advance.
- The User is responsible for operating laser cutters safely, choosing materials, and checking a Design before making it. A User who puts objects made from Designs on the market, in particular toys, is responsible for meeting the safety requirements for those objects, including toy-safety rules where they are sold. Objects with small parts can be a choking hazard for small children.
- Towards a User who is neither a Consumer nor treated as one:
- the Provider is not liable for lost profits;
- the Provider's total liability is limited to the fees the User paid for Pro in the 12 (twelve) months before the event giving rise to the damage;
- the limits in points 1 and 2 do not apply to damage caused intentionally.
14. Complaints
- Complaints about the Services may be sent by email to the address in section 2.2.1.
- A complaint should include the User's email address, a description of the problem and what the User asks for. The Generator, parameters, browser and device used help us investigate.
- The Provider will reply within 14 (fourteen) calendar days of receiving the complaint, by email or, at the User's request, by post.
- Complaints about payments, invoices and payment refunds are handled by Paddle at https://paddle.net; the Provider forwards such complaints to Paddle and tells the User.
15. Out-of-court dispute resolution
- A Consumer may use out-of-court complaint and redress procedures. Consumers in Poland may, in particular, ask a municipal or district consumer ombudsman (rzecznik konsumentów) or the Voivodeship Trade Inspectorate for help; see https://prawakonsumenta.uokik.gov.pl. Consumers in other EU countries may contact their national consumer bodies or the European Consumer Centres network.
- Out-of-court procedures are voluntary and require the consent of both parties.
16. Personal data
The Privacy Policy describes how Users' personal data is processed.
17. Changes to these Terms
- The Provider may change these Terms for important reasons, in particular:
- changes in the law affecting these Terms;
- a court judgment or authority decision concerning the Service;
- changes to the scope or way the Services are provided, including new plans;
- changes to the terms of Paddle or other suppliers the Services depend on;
- the need to keep the Service secure.
- The Provider will notify Account holders by email, and other Users by a notice in the Service, at least 14 (fourteen) days before a change takes effect.
- A User who does not accept a change may terminate the Account Agreement with immediate effect before the change takes effect. If the change materially worsens the conditions of paid Pro, the User receives a pro-rata refund for the unused period.
- For Pro paid before a change takes effect, the previous price terms apply until the end of the paid period.
18. Final provisions
- These Terms are available free of charge in the Service in a form that can be downloaded, saved and printed.
- These Terms are governed by Polish law. This choice of law does not deprive a Consumer whose habitual residence is in another country of the protection of the mandatory provisions of that country's law.
- Disputes with a User who is neither a Consumer nor treated as one are resolved by the court competent for the Provider's place of business. Jurisdiction in disputes with Consumers follows the law.
- These Terms are made in Polish and English. In case of discrepancy, the Polish version prevails for Consumers habitually resident in Poland and the English version for all other Users.
- If any provision is found invalid or unenforceable, the remaining provisions remain in force.
